Death Row is NOT a creative solution. It's getting rid of something we, human beings, can't handle. State law allows individuals to make determinations which resulted in a death sentence and then allows others to make determinations to affirm that sentence.<br /><br />None of that, none of it, was mandated.<br /><br />Nor is there any requirement under state law that the sentence must be carried out. The Governor has the absolute power to commute the sentence if he is so inclined.<br /><br />Governor Kasich, like the prosecutors, the judges, and the parole board, decided - each of them individually, that Baston should die.<br /><br />One can argue about whether they were right. That's ultimately a question of balances and values and personal morality and who knows what all else. But there can be no argument about whether individuals made the decision. Plenty of law abiding citizens do not put themselves in these situations. The fact that he blames some guy named "Ray" who has not surfaced in 17 years is pretty sad too. If "Ray" was a robber and a murderer, the chances are relatively high that he would act again if still under free will.
